1. Introduction
1.1. The Hentley Farm Membership Program is a program designed to recognise and reward Members who predominantly dedicate their wine purchases directly with Hentley Farm Pty. Ltd. and related brand activities.
1.2. These Terms and Conditions form the basis of the Hentley Farm Membership Program. They are intended to protect both Members and Hentley Farm Pty. Ltd. It is the Member’s responsibility to read and understand them.
1.3. Every member is bound by these Terms and Conditions.
2. Definitions
2.1. In these Terms and Conditions, unless the context otherwise requires:
'(Active) Member' at a point in time, means the individual who has earned or redeemed ‘Tally’ on their Membership Account of their same, legally recognised, name.
'Benefits' or ‘Privileges’ or ‘Rewards’ means any of the facilities, discounts, pricing, services or arrangements offered or available to a Member as a result of membership with Hentley Farm, including earning and redeeming Tally and Rewards;
'Membership Account' means the record of a Member's Membership, which is available to the Member online at hentleyfarm.com.au;
'Points' or ‘Tally' means points awarded to Members in Hentley Farm Membership Program pursuant to these Terms and Conditions unless otherwise stated. Unless otherwise expressly specified, 'Points' do not include any spend on Hentley Farm products that are not made directly through Hentley Farm Pty. Ltd. Points may also be referred to as ‘spend' in Hentley Farm marketing and communications.
'Membership’ means the membership program operated by Hentley Farm Pty. Ltd.;
‘Tier’ means the level at which a members spend ranks them within the Membership program.
4. Membership Tiers
4.1. There are three membership tiers in the Hentley Farm Membership Program. The entry tier is ‘Friends of the Farm’. Members may progress to the higher tiers – Tally Room, Clos Otto Club – by accruing tally spend.
4.2. Tally is earned through direct wine purchases made with Hentley Farm Pty. Ltd.
4.3. Tally is not earned on:
4.3.1. Hentley Farm purchases made through retailers or third-party stockists,
4.3.2. Dining or Wine Tasting experiences had at Hentley Farm Pty. Ltd.,
4.3.3. Prizes, or products acquired at auctions.
5. Your Obligations
5.1. It is the member’s responsibility to inform us if:
5.1.1. Personal details change (including, but not limited to, your address, email address or phone number). If we do not have your correct details, we may not be able to contact you about your account or send you offers or rewards, and we may also restrict operations on your account (such as member tier pricing redemption).
5.1.2. You would like your details removed.
7. Member Privileges
7.1. Tally will be accrued to your membership account after a qualifying transaction has been made by using your membership details online or directly with a Hentley Farm team member. Hentley Farm Pty. Ltd. is not responsible for any delay or failure of member detail notification on member-related transactions resulting in Tally spend unassigned to a member account.
7.2. Membership Tally can only be accrued via purchases made directly with Hentley Farm Pty. Ltd. Product purchases made via stockists cannot be redeemed against a membership.
7.3. Tally accrued on cancelled or refunded transactions is forfeited by the member.
7.4. We may correct erroneous, invalid Tally or adjust at any time, even if the member’s tier status is affected.
7.5. Lifetime Tally is documented by Hentley Farm Pty. Ltd. and can be released to the member upon request.
7.6. Year-to-date Tally can expire if the member does not meet the Tier requirements to retain status within 12 consecutive months.
7.7. You cannot transfer, sell, gift, or donate your Tally to another person.
7.8. Membership Tally has no dollar, cash or monetary value.
8. General
8.1. We may, at our discretion, make any change we see fit to these Terms and Conditions, including, without limitation:
8.1.1. The range of Tally to acquire any tier status;
8.1.2. The transactions or products on which Tally can be acquired;
8.1.3. The period for expiry of any existing Tally on your membership account;
8.1.4. The inclusions and value of membership inclusions, privileges and rewards.
8.2. We will give you notice of any change to the Terms and Conditions at our sole discretion;
8.2.1. Via the Hentley Farm website; and/or
8.2.2. By direct communication sent to members.
8.3. In addition to our right to terminate a member account (1.4), we may terminate or suspend a Hentley Farm Membership immediately and without notice where you:
8.3.1. Fail to comply with these Terms and Conditions;
8.3.2. Provide misleading information or make any misrepresentation to us, Hentley Farm Pty. Ltd.;
8.3.3. Are abusive or offensive to any of our staff or representatives.
8.4. Where your Membership is terminated, all of your Tier privileges will cease, your Tally will no longer be accrued, and your existing Tally will be deleted.
8.5. Respecting your personal information is very important to us. The Hentley Farm Privacy Policy forms part of these Terms and Conditions. The Privacy Policy sets out what personal information we collect, how we use it, to whom we may disclose it and what your privacy choice are. The Hentley Farm Privacy Policy is available on the Hentley Farm website or on request from your Brand Ambassador.
8.6. We will not be liable to you for the termination of the Hentley Farm Membership Program for any reason whatsoever, including (without limitation) for any Tally or unclaimed privileges linked to your account.
8.7. We may provide your membership details to parties involved in the purchase of any part of our business.
8.8. Any liability we may have to you in negligence, breach of membership terms or otherwise, and all conditions and warranties as to the condition, suitability, quality, fitness or safety of any goods or services supplied by Hentley Farm, whether express or implied by statute, are excluded to the extent permitted by law, and, where liability cannot be excluded, our liability to you will in all cases be limited to:
